This case concerned the difficult issue of the overlap between education and care needs. The parents alleged that the child had a need for a 24 hour curriculum relying on expert evidence which suggested that anything that helped the child to learn by way of repetition was to be regarded as an educational need and provided for in Part 3 and Part 4 of the Statement. The Special Educational Needs and Disability Tribunal rejected that argument.

R (M) –v- Local Government Ombudsman (2006) was a case that concerned a parent’s complaint to a school about an incident that happened some years earlier.
The headteacher reaffirmed her earlier decision when she investigated the matter and the complaint was then taken up with the local authority who did not interview the pupil and rejected the complaint. There was then a subsequent complaint to the Local Government Ombudsman who refused to deal with the complaint saying that he did not have jurisdication to interfere with internal matters within schoos.
